Terms Of Service

Scope and purpose

These general Terms of Service (“Terms of Service”) shall apply to all contracts entered into between us, Framebird UG (haftungsbeschränkt), Eberswalder Str. 29, 10437 Berlin, Germany (“Framebird”, “we”, “our” or “us”) and you as our customer (“Customer” or “you”). You are only allowed to use Framebird's services if you accept the Terms of Service.

The version of the Terms of Service that apply to your contract shall be the ones in force at the time of the conclusion of the contract. We do not accept differing Terms of Service of the Customer, even when the Customer draws our attention to said differing Terms of Service and we do not expressly reject the inclusion of these Terms of Service.

Our services

Thanks for using Framebird! Framebird’s business is the provision of an online storage application that enables you to store and share files through its webpage framebird.io (the “Webpage”) and its own mobile application (the “Framebird App” and together with the Webpage the “Services”).

Framebird does not guarantee that the Services meet your specific requirements or expectations. Customers require a personal user account (“Personal Account”) to be able to use the Services. For this purpose, they must register with their name and email address.

Customers are solely responsible for maintaining accurate and up-to-date information on their Personal Account and for all content posted on it, as well as any activities that occur under their account. Customers must take reasonable precautions to prevent unauthorized access to their Personal Account on the Services. Any loss or damages resulting from the Customer's failure to do so are not the responsibility of Framebird. Customers agree to immediately inform Framebird if they become aware of any unauthorized use of their Personal Account. Only customers who are at least eighteen (18) years old may access and use the Paid Services (as defined below). Access to and use of the Paid Services are prohibited for anyone under the age of eighteen (18). Customers must not (I) use or attempt to use someone else's Personal Account or access someone else's (personal) data, (II) create a Personal Account using false or another person's identity, (III) access the Services in any manner other than through the methods provided by Framebird, (IV) use the Services in violation of any applicable laws or regulations, (V) send any advertising or promotional material, such as “junk mail“, “chain letters“, “spam“, or any similar solicitation, (VI) use the Services in a way that infringes on the rights of others or restricts or inhibits anyone's use or enjoyment of Services, or (VII) attempt to interfere with the proper functioning of Services.

Pricing

To utilize the Services, you may be required to make a payment, which may be on a recurring basis, known as the ”Paid Services.” The Webpage or Framebird App displays the Paid Services and their corresponding prices, which include the relevant VAT, if applicable. However, any other taxes or duties, if applicable, are the Customer's responsibility.

Payment

In case the complete payment for the Paid Services has not been made, Framebird holds the authority to temporarily freeze the Personal Account or limit access to certain features of the Services. This temporary freeze or suspension of features will continue until a valid payment method is used. Payment through credit card and PayPal is accepted through our payment provider lemonsqueezy.com, and Framebird may modify the available payment options on the Webpage and/or Framebird App without prior notice.

You represent and warrant that:

• You have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase
• The information you supply to us is true, correct and complete.

Our order process is conducted by our online reseller Lemon Squeezy (lemonsqueezy.com). Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides all customer service inquiries and handles returns. By purchasing any product, you are also agreeing to Lemon Squeezy's buyer's terms and conditions: https://www.lemonsqueezy.com/terms. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Cancellation

Apart from your cancellation rights under local mandatory consumer law, you have the right to cancel your subscription during the first 14 days, unless you start using the Service during this period whereby you waive your right to cancel.

The subscription period will be renewed automatically for the selected subscription period, unless you have cancelled your subscription on time (before the last day of your subscription).

If you decide to cancel your subscription, you will retain access to the Services until the conclusion of your paid subscription period. For example, if your monthly subscription began on July 12th, and you cancel on November 19th, you will maintain access until December 12th.

Violation of the Terms of Service

Framebird reserves the right to investigate, provide to third parties, (temporarily) block and/or permanently delete from it servers, without prior notice or liability, any Content and/or account information or to block anyone from accessing any part of the Services, when Framebird determines, at its sole discretion or after receiving substantiated and valid complaints, that you breach these Terms or act in violation of any applicable law or regulation.
